All Pink Octopus Art designs are original works created by Amie Swannell and are protected under UK copyright law.

When you purchase a design, you are purchasing a licence to use the artwork — not ownership of the artwork itself.

All licences are non-exclusive. Pink Octopus Art retains the right to sell and license all artwork across platforms, including our own website, print partners, and marketplaces.

1️⃣ Personal Use Licence (Included)

Every purchase automatically includes a Personal Use Licence.

You may:
✔ Print at home
✔ Create gifts
✔ Use in personal craft projects
✔ Share finished personal projects on social media

You may NOT:
✘ Resell or share the digital file
✘ Upload to print-on-demand sites
✘ Use the design on products for sale
✘ Claim the design as your own

2️⃣ Small Business Commercial Licence

Up to 100 Units Per Design

💷 £12 per design

This licence is perfect for handmade businesses and small makers.

You may:
✔ Create up to 100 physical products per design
✔ Sell on Etsy or your own website
✔ Use SVGs on handmade items
✔ Use seamless patterns for small fabric runs
✔ Sell 3D printed physical objects made from the file

You may NOT:
✘ Upload to print-on-demand marketplaces (Redbubble, Amazon Merch, etc.)
✘ Sell more than 100 units
✘ Sell or share the digital file
✘ Use for wholesale production

This licence covers one design only.

3️⃣ Extended Commercial Licence

Unlimited Units + Print-on-Demand Rights

💷 £85 per design

For growing brands and larger production.

You may:
✔ Sell unlimited physical products
✔ Upload to print-on-demand platforms
✔ Produce fabric, wallpaper, & wholesale runs
✔ Sell 3D printed objects commercially
✔ Use in large-scale production

You may NOT:
✘ Resell or distribute the digital file
✘ Modify and resell as a new digital product
✘ Claim copyright ownership

This licence covers one design only.

Licence Structure Overview

All Pink Octopus Art designs are licensed, not sold.

The purchase of a digital file grants a limited, non-exclusive, non-transferable licence in accordance with the tier selected.

Personal Use Licence

Included with every purchase.
Permits private, non-commercial use only.

Small Business Commercial Licence

Permits sale of up to 100 physical products per licensed design.
Digital redistribution is strictly prohibited.
Does not permit upload to third-party print-on-demand marketplaces.

Extended Commercial Licence

Permits unlimited physical product sales and third-party print-on-demand platform use.
Digital file redistribution remains prohibited.

All licences apply per design, per purchaser.

Pink Octopus Art retains full copyright ownership at all times.

1. Do I need a licence for personal projects?

No. Every purchase automatically includes a FREE Personal Use Licence.

You can print, craft, and create for yourself or as gifts.
You just can’t sell the finished products without a commercial licence.

2. I want to sell items using your design. What do I need?

If you are selling physical products, you will need either:

• Small Business Licence (£12) – Up to 100 products per design
• Extended Commercial Licence (£85) – Unlimited products + POD rights

Each licence applies to one design only.

3. Can I sell on Etsy with the Small Business Licence?

Yes ✅

You may sell up to 100 physical products per design on Etsy or your own website.

You may NOT upload the design to print-on-demand platforms under this licence.

4. Can I use your design on Print-On-Demand sites?

Only with the Extended Commercial Licence.

This includes platforms such as:

• Redbubble

• Amazon Merch

• Printify

• Other third-party POD services

5. Can I sell 3D printed items made from your files?

Yes — within your licence limits.

• Small Business Licence: Up to 100 physical prints
• Extended Licence: Unlimited physical prints

You may never resell or share the digital 3D file.

6. Can I resell the digital file?

No ❌

Digital redistribution is never permitted under any licence.

You may not:

• Share the file

• Upload it to file-sharing sites

• Include it in digital bundles

• Modify and resell as your own digital product

7. Is your licence exclusive?

No. All licences are non-exclusive.

Pink Octopus Art retains full copyright ownership and may continue selling or licensing the design elsewhere.

8. Do I need to credit Pink Octopus Art?

Credit is appreciated but not required.

If you would like to credit, you may use:
“Design by Pink Octopus Art”

9. What happens if someone uses a design without a licence?

Unauthorised commercial use is a breach of copyright and may result in licence termination and legal action.
